This TERMS OF SERVICE AGREEMENT (”Agreement”) is a legal agreement between Think House Group, Inc., a Minnesota corporation whose notice address is 2704 Pillsbury Avenue South, #1, Minneapolis, MN 55408 (”Owner”), who owns the website located at the domain name “thinkhousegroup.com” (”Website”) and each individual and/or entity who views, uses and/or interacts in any way with the Website (“User”).

1. ACCEPTANCE OF TERMS
By using this Website, each User hereby agrees to the terms contained in this Agreement.

2. DESCRIPTION OF SERVICE
Owner provides Users with access to communication, information and interaction resources for the purpose of disseminated information related to the construction industry.

3. COPYRIGHT
The content and design of the Website are protected under applicable copyright laws, including, but not limited to the Digital Millennium Copyright Act. The copying, distribution, use, or publication of any part of the Website is strictly prohibited. Content submitted to or posted on the Website becomes and shall forever remain the property of the Owner. User shall not acquire ownership rights to any content submitted to, posted on, or viewed on or through the Website. Copyrighted materials of third parties shall remain the property of such parties and posting said materials does not constitute a waiver of any preexisting rights.

4. REGISTRATION
Some sections, pages, and content on the Website may require the User to register for an account. If requesting registration, the User agrees to provide full, complete, and accurate personal information. Personal information submitted to the Website will be handled in accordance to the published Privacy Policy. The Owner reserves the right to disable, alter, reject, or delete any user account for any reason with or without cause and without warning to the User. Owner may make arrangements through third parties to advertise or sell products or services on or through the Website. Owner is not responsible for and assumes no liability for any mistakes, omissions, or representations of such third parties.

User acknowledges that information and options expressed in third party content are solely those of the author and do not necessarily reflect the opinions of the Owner.

7. RESTRICTIONS ON USE
User may not remove, decompile, disassemble or reverse engineer any Website software or use any network monitoring or discovery software to determine the Website architecture under any circumstances. User may not use any automatic or manual process to harvest information from the Website for the purpose of gathering information for the transmission of unsolicited commercial email, telephone calls, or facsimile transmission. User may not under any circumstances submit, post, or use any tool, method, or software to display commercial advertisements or solicitations of any kind, except as described in Section 5.

User may not reproduce, duplicate, copy, print, republish, display, distribute, transmit, sell, rent, lease, loan or otherwise make available in any form or by any means all or any portion of the Website or any content and materials retrieved therefrom for any commercial or noncommercial purpose without the express written permission of the Owner.

Owner provides no warranty, expressed or implied, that the information contained on or made available through the Website is accurate, reliable, or suited for any specific purpose.

10. NO LEGAL ADVICE
Information contained on or made available through the Website is not intended to and does not constitute legal advice, recommendations, mediation or legal counseling under any circumstance. Website Owner does not warrant or guarantee the accuracy or completeness of the information contained on or through the Website.

11. LIMITATION OF LIABILITY
Owner and any affiliated parties shall not be liable for any loss, claim, or damage of any kind resulting from the use of the Website, information contained therein, or products or services obtained thereof. In no event shall Owner be liable for special or consequential damages, either in contract or tort, whether or not the possibility of such damages has been disclosed to Owner in advance or could have been reasonably foreseen by Owner. IN THE EVENT THAT THIS LIMITATION OF DAMAGES IS HELD UNENFORCEABLE THEN THE AGGREGATE LIABILITY OF OWNER AND AFFILIATED PARTIES IN CONNECTION WITH ANY CLAIM ARISING OUT OF OR RELATING TO THE WEBSITE AND/OR THE PRODUCTS, INFORMATION AND SERVICES PROVIDED THEREIN SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100) AND THAT AMOUNT SHALL BE IN LIEU OF ALL OTHER REMIDIES WHICH USER MAY HAVE AGAINST OWNER AND AFFILIATED PARTIES.

12. SCOPE OF AGREEMENT
If the scope of any of the provisions of the Agreement is too broad in any respect whatsoever to permit enforcement to its full extent, then such provisions shall be enforced to the maximum extent permitted by law, and the parties hereto consent and agree that such scope may be judicially modified accordingly and that the whole of such provisions of this Agreement shall not thereby fail, but that the scope of such provisions shall be curtailed only to the extent necessary to conform to law.

13. AMENDMENT
The Owner may amend this agreement at its sole discretion at any time without notice to the User.
